We may vary the terms and conditions for the use of these service from time to time by posting revised terms and conditions on the site. For next visits to our site it is however your responsibility to check whether the terms and conditions have been revised. Use of this website after the date on which we post revised terms and conditions shall be deemed to constitute your acceptance of the revised terms and conditions.You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions. If you do not agree to be bound by these terms and conditions you must stop using this site immediately.

HOW TO ORDER

You can order any of our range of storage beds or storage furniture for bedrooms using the methods below.

Online: fast secure and convenient. click on the product(s) you wish to purchase and follow the instructions.

Telephone. Call our sales team on 01327 226275. Payment can be taken over the phone by credit/debit card.

By e-mail at sales@livingstorage.co.uk. Please detail the items you wish to purchase and leave contact telephone number. We will contact you as soon as possible to follow up your order request. Please do not send any payment details by e-mail.

By post. Add your required products to the basket as normal, then print off the completed order and send together with a cheque to our address shown below.

ORDER PROCESSING

We will contact you to confirm receipt of your order and completion of the purchase.  and make delivery arrangements.

Delivery of your goods will normally be within 30 days from receipt of payment. In the event of an item being out of stock or subject to expected delays we will be advise you at the order processing stage, together with an estimated delivery date. No liability can be accepted by The Living Storage Co Ltd for failure to deliver within these estimated delivery times. Furthermore we shall not be liable for any loss or damage whatsoever arising directly or indirectly from any delay in the delivery of your order. If we cannot deliver your order within the estimated time we will advise you try to agree on another time for delivery. Should this be unacceptable to you, we will refund you within 30 days.

We do not accept orders from any person under 18 years of age without the consent of that person's parent or carer.

 

PRICING

All prices displayed are in GB Pounds Sterling, and include VAT at the prevailing rate for the goods or services being supplied. Unless stated otherwise, the price detailed alongside a product photograph refers to purchasing one item of the specified size, regardless of the number or size of items displayed in the picture.

Our displayed prices include the net item price as well as VAT at the current rate

Any additional delivery charges will be indicated when you place your order. There are no hidden extra costs.

Prices are subject to change without notice.

Photographs of products on our website may show additional props to help visualize their use. These props are not included in the sale of the goods displayed. Please contact us before purchase if you are unsure what the offer includes.

For deliveries outside of mainland UK: delivery charges will be subject to quotation depending on item volume/weight and delivery address. Please contact us for a quotation before you complete your purchase.

 

TAX
Value Added Tax (VAT) is payable on all goods or services delivered within the EU.

 

PAYMENT

Full payment will be taken with the order. We will need cleared funds to start processing your order. We can accept any of the following methods of payment:

You can make secure online payments by credit/debit card. The checkout process is fully encrypted using the latest secure certificates making your details secure and impossible to be intercepted by others. We will process your credit/debit card details and validate them. We do not retain customer credit card details. The only information we keep is whether your transaction is successful or not and your address details for future orders. No credit card details are kept on the Living Storage Co website at any time.

• Personal or Bank Cheques

However, should you still prefer to pay by cheque, please contact us for a proforma invoice, which you need to send to us together with your signed cheque for the total amount including delivery. Please make your cheque payable to The Living Storage Company Ltd.

We require 5 working days for bank clearance after which we will contact you to confirm the order and arrange delivery. A written confirmation of the order processing will be sent to you.

We can accept credit or debit card payments by telephone. These will be processed and credit card details are subsequently shredded. If you are making a credit or debit card payment by phone we are only able to deliver to the cardholders address.

We reserve the right to refuse orders from any customer.

 

CANCELLATIONS

Our legal obligation to you, our customer, under the new European Directive incorporated into UK Law by The Consumer Protection (Distance Selling) Regulations 2000, is to grant you the unconditional right to cancel your order from the date of the contract and up to the point where you have been contacted to arrange delivery and arrangements for delivery have been agreed.

Should you make a cancellation beyond this point, we will deduct from your refund the amount of any delivery charges and cancellation penalties which The Living Storage Co Ltd may have incurred as a direct result of your order cancellation.

We will make a refund to you within 30 days of the cancellation.

Cancellation of made-to-order products:
Should you wish to cancel your made-to-order product for any reason, it is unlikely that we could sell it to another customer. We will charge a cancellation fee of 50% of the full selling price. In respect of made-to-order products our usual refund policy does not apply and products cannot be returned or exchanged unless faulty.

 

DELIVERY

For mainland delivery charges please click here.

Delivery will be undertaken by The Living Storage Co Ltd staff, or by our approved carrier to any UK mainland address (excluding Northern Ireland).

Delivery of smaller items is included in the price. Any applicable delivery charges for larger items to the delivery address given will be displayed on checkout prior to any payment being taken.

Any subsequent change of the delivery destination may incurr additional delivery charges.

We will contact after processing your order to arrange a mutually convenient delivery date. You may contact us to re-schedule a delivery without additional cost up to seven days prior to the agreed date. Changes within seven days may incur additional charges.

A re-delivery charge will be made if a further delivery is necessary because:

• you are not at home to receive your order at the pre-arranged delivery time.

• your goods must be redelivered because they cannot fit into the premises without additional work or equipment.

• your goods must be redelivered for any other reason.

It is the responsibility of the person placing the order to ensure that the goods are of the correct dimensions both for access to the delivery address and the space for which the goods are intended.

We will need to park within a short walking distance with good access to the delivery address. Please advise us of any height, weight or parking restrictions which may hinder delivery. Customers will be required to obtain a parking permit if applicable to the delivery address.

Failure to disclose this information may result in an aborted delivery.

We reserve the right to require proof of identification from you when making a delivery . We will require a signature for receipt for the goods on arrival.

For deliveries made by us to addresses in mainland UK, our delivery team will exercise every caution and extend every courtesy during delivery and assembly. We cannot be held liable for any accidental damage to your property or person, however caused, and only enter your premises under these conditions.

 

PACKAGING

We pay great attention to the packaging of all the products we sell to prevent damage in transit. We choose environmentally friendly packaging and recycle whenever possible. If we are assembling the product for you we will take away all packaging materials for recycling.

 

DAMAGED GOODS

Should the product you ordered show a manufacturing fault or have been damaged in transit, you will need to mark this on the delivery note or notify us in writing (post, fax or email) strictly within 3 days of delivery. We can then either

• replace the defective item as soon as possible

 • offer you a full refund within 30 days.

Where the defect or damage is readily visible, this should be highlighted at the time of delivery. We shall be under no liability whatsoever in respect of any defect caused by fair wear and tear, by negligence or wilful damage, by failure to follow our instructions or those given by the supplier, by alteration of the goods without our approval or by any other act of misconduct by third parties.

We will usually refund any money received from you using the same method originally used by you to pay for your purchase.

 

RETURNS AND REFUNDS

If for any reason you are unhappy with your purchase you have seven working days from delivery  to cancel the contract for a refund. Please note we cannot accept goods for return that have been damaged or modified in any way. Please contact as soon as possible us you wish to return the goods, and we will give you a return authorisation reference and arrange collection of the goods.  You may do this by phone, mail or email. Unless there is a manufacturing fault or the goods were damaged in transit (see Damaged Goods), a charge will be made for collection. We will arrange collection of the goods. We will make a refund to you within 30 days of the cancellation.

Products we are unable to refund or exchange:

Once the packaging has been opened, for reasons of hygiene and safety, we are unable to refund or exchange mattresses, mattress toppers, duvets, pillows, unless they are faulty.

RISK AND PROPERTY

No property or title to goods shall pass to you unless and until the full amount of the value of the goods as invoiced has been credited to our bank account without recourse or we have received the full amount in cash. Risk of damage to or loss of the goods shall pass to you at the time of delivery or attempted delivery or, if you wrongfully fail to receive the delivery as arranged, at the time when the Company has tendered delivery of the goods.

As title of the goods does not pass until delivery you need to ensure that there is adequate insurance in place until the point of delivery.

The Products will be at your risk from the time of delivery.

 

WARRANTY

In the very unlikely event that you should find goods to be defective on delivery, in respect of materials or workmanship only, you need to notify us in writing within 3 days of receipt. We will investigate and examine the goods and to our discretion either replace the defective goods or refund the purchase price (see Damaged Goods)
In the event of breakdown of any functioning part of your product within the warranty period we will provide an on-site repair service.

All repair services are provided by our authorised service technicians.

If we decide your product cannot be repaired, or is uneconomical to repair, we will refund the purchase price less a pro-rata charge for usage over the warranty period.
Occasionally, you may have to pay for the repair and claim the cost of the repair from us.

These following service and repair costs are excluded from the warranty:

• Repairs due to breakdown caused by use other than domestic by you or family, or by deliberate damage or neglect of the product, or through use of the goods not in accordance with the manufacturer’s instructions.

• Repairs due to fair wear and tear of mechanical parts.

• Cosmetic damage and/or non-functional parts which do not affect the normal use of the product including cabinet trim, scratches and rust. 

• Any loss suffered as a result of not being able to use the product, or any loss other than the repair or the replacement cost of the product.

We reserve the right to charge for the expense of a service call when no fault has been found with the product after we have inspected it.

We will not be liable for any goods which have been repaired or altered in any way.

 

EXCLUSION OF CONSEQUENTIAL LOSS

The Company shall not be liable for any consequential or indirect loss suffered by the Buyer whether this loss arises from breach of a duty in contract or tort or in any other (including loss arising from Company’s negligence). Non- exhaustive illustration or consequential or indirect loss would be:

• loss of profits

• loss of contracts

• damage to property of the buyer or anyone else: and 

• personal injury to the Buyer or anyone else and personal injury to the Buyer or anyone else (except so far as such injury is attributable to the company’s negligence)


CONFORMITY OF GOODS

All descriptions of the Products on our site are correct at the time of publication on our site. We have a policy of continuous product development and reserve the right to amend the specification of Products without prior notice in relation to future sales.

We take every possible care to make sure that the descriptions, specifications and colours of our products are correct. However, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you.

Due to the individual and often handmade nature of our products, slight colour and size variations are always possible. However, these variations will not alter the overall appearance or dimensions of the products.

It is your responsibility to check that all the details on the order form are correct, including the exact specifications of the Products and delivery details.

Our Products are intended solely for domestic use in the UK and we give no guarantees or undertakings in respect of the use of our Products for commercial purposes. We are in no way responsible for any non-domestic or commercial use of our Products and by agreeing to these terms and conditions, you agree that you will use the Products exclusively for domestic purposes.

 

OUR LIABILITY

We warrant to you that any Product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.

Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Product you purchased and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

This does not include or limit in any way our liability:

(a) for death or personal injury caused by our negligence; (b) under section 2(3) of the Consumer Protection Act 1987; (c) for fraud or fraudulent misrepresentation; or (d) for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us.

 

COMPLAINTS

We want you to be absolutely happy with the service we offer. If there is anything not to your complete satisfaction please let us know immediately so that we can act accordingly and effectively. We aim to respond to all complaints within 2 working days.

PROVISION OF SERVICE

We agree to provide you with the service in accordance with these terms and conditions.

We cannot guarantee that the service will be provided fault-free and we do not undertake or warrant that the service will be free from defects.

We may temporarily have to suspend the service either partially or completely for any reason. We will restore the service as soon as reasonably practicable after a suspension. We will not be liable to you for any loss which you incur as a result of any such suspension.

Although we aim to give you reliable product specifications and service information, the pages contained in this site may contain technical inaccuracies and typographical errors. The information in these pages may be updated from time to time and may at times be out of date. We accept no responsibility or liability for this.

The information contained in the material in this site is for information purposes only.
We will not be liable for being prevented from carrying out our obligations as a result of any cause beyond our control (e.g War, Flood, Strikes, Acts of God, Technical Failure etc) and we shall be relieved of our obligations and liabilities for as long as such fulfillment is prevented.

BY PROVIDING PERSONAL DATA TO US, YOU CONSENT TO THE PROCESSING OF YOUR DATA BY US AS DESCRIBED IN THIS PRIVACY POLICY.

We are committed to protecting your privacy. We will not send you marketing material and we will not pass on any of your details to any third parties. We will only use the information that we collect about you lawfully and in accordance with the 1998 Data Protection Act and we ensure you that all information is held securely and will be revealed to you or deleted upon your specific request.

We only collect data which is adequate, relevant and not excessive in relation to our purpose of processing your order, and we do not keep this data for longer than necessary. Your credit/debit card details will not be seen or held by us (see Payment). In order to process your order it may be necessary to disclose your contact telephone number to our delivery company in case they need to contact you.

Although we do give you the opportunity to provide us with more detailed personal information about yourself through our Visitor/Customer Profile Form, we assure you that these details will not be of a sensitive nature, that they will be held securely in accordance with our own internal security policy and with the law, and that we may use your details for the sole purpose of - improving customer services within our company only. - informing you about new products and services, promotions or exclusive offers brought to you by The Living Storage Company - for our own internal statistical analysis only.
At each point of data collection on our website you are given the opportunity to opt-out of receiving material from us.

The Living Storage Co Ltd uses Secure Server software to protect the data you provide each time you place an order. This software encrypts the computer data and messages by means of a 'key', so that it can be reconverted only by an authorised recipient holding the matching 'key'. This minimises the risk of the data being intercepted before we receive it. Credit/debit card information is subject to 128-bit encryption, which is the highest level protection available against fraud. Ask your credit card company for details on the level of protection they offer.

We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening although this will prevent certain features from working. The information collected in this way can be used to identify you.

INDEMNIFICATION

You will be liable to indemnify us for all costs, expenses, claims, losses and damages including professional fees, properly incurred by us as a result of any breach of the terms and conditions of the contract by you. This will include any steps that we decide to take to remedy the breach.


GOVERNING LAW

This agreement shall be governed by and construed in accordance with the law of England and Wales and each party agrees to submit to the jurisdiction of the English Courts.


ENTIRE AGREEMENT

These terms and conditions contain the whole agreement between the parties and supersedes any other written or oral agreement between the parties and the parties confirm that they have not entered into this agreement on the basis of any representations that are not expressly incorporated into this agreement.



CONTRACTS (RIGHTS OF THIRD PARTIES) ACT 1999

The Contracts (Rights of Third Parties) Act 1999 shall not apply to this agreement.
